PERLINDUNGAN HAK CIPTA ILUSTRATOR TERHADAP KARYA SENI DIGITAL DI INDONESIA

Abstract

Artikel ini ditulis dengan tujuan untuk memahami bagaimana ilustrator dilindungi secara hukum, memperoleh kepastian hukum dan mengambil langkah hukum yang tersedia ketika terjadi pencurian karya seni digital oleh para ilustrator berdasarkan peraturan hukum di Indonesia. Pada artikel ini, metode penulisan yang diterapkan adalah metode penelitian hukum normatif. Dalam studi ini, ditemukan bahwa setiap orang yang menciptakan karya memiliki hak untuk dilindungi secara hukum sesuai dengan ketentuan UUHC serta beberapa regulasi lainnya terkait kekayaan intelektual. Dalam perspektif hak kekayaan intelektual, para ilustrator memiliki hak untuk mendapatkan perlindungan hukum terhadap karya seni yang mereka ciptakan. Salah satu pemenuhan hak illustrator tersebut adalah melalui kepastian hukum dengan diberlakukannya UUHC.

ABSTRACT

This article was written with the aim of understanding how illustrators are legally protected, obtain legal certainty and take available legal steps when digital artworks are stolen by illustrators based on Indonesian law. In this article, the research method applied is the normative legal research method. In this research, it was found that everyone who creates works has the right to be legally protected with the regulated of Act Number 28 of 2014 concerning Copyright and several other regulations related to intellectual property. In the perspective of intellectual property rights, illustrators have the right to obtain legal protection for the works of art they create. One of the illustrators' right fulfillments is through legal certainty with the regulated of Act Number 28 of 2014 concerning Copyrights.
