Implementasi Kewajiban Notaris Bersikap Tidak Berpihak Dalam Pembuatan Akta Otentik Di Wilayah Denpasar

Abstrak

The aim of this research is to raise issues related to the fair application of the law for Notaries in carrying out their duties and obligations in the process of making authentic deeds, the consequences this causes, as well as legal sanctions against Notaries who act impartially in exercising their rights. This empirical juridical research uses factual, analytical and conceptual approaches as well as data collection techniques from document studies and interviews. After analysis, it was The duties and obligations of a notary based on Notary Public Position Act (UUJN) and the code of ethics must be neutral in relation to the illegality of the person, not acting as an agent. Authentication in ratifying and not making authentic deeds for the benefit of the interests of the family and relatives in a straight line from top to bottom without level limits and horizontally up to the third level and does not provide benefits in the form of ownership of an object/object for people who appear at the time of perform an authentic deed. The legal consequence of an authentic deed if a notary makes a deed legalized by a notary is that the authentic deed only has legal value and can be sued by the aggrieved party.
