Studi Kasus : Pelanggaran Rahasia dagang antara Huawei China dan T – Mobile USA Inc

Abstrak

This study aims to describe the reasons for the US Government to formulate the Economic and Trade Agreement with China, through the causality explanation method. Huawei's theft of trade secret information against T-Mobile has sparked tensions between the US and Chinese governments. T – Mobile responded to the action by reporting Huawei to the Western District Court. This action led to an escalation of conflict between the two countries. Then, President Trump changed the direction of his policy by involving Huawei in the deal even though Huawei was considered a threat to its national interests. Therefore, this research uses the framework of Intellectual Property Rights and the National Interest to answer the reasons behind the US changing policy direction and making agreements regarding China's intellectual property law regulations. This study finds that it is in the national interest of the US to protect the 'level playing field' of domestic firms and US workers.
